Decisions concerning particular administrative matters, issued through the Royal Chancellery upon the recommendation of the Secretariat of State or another competent authority.
Administrative Decisions apply the laws, Sovereign Decrees, General Regulations, and established procedures of Kaharagia to individual cases.
The recommending authority is responsible for the facts, policy, and administration of the matter. The Royal Chancellery is responsible for the formal issuance, authentication, registration, and publication of the Decision.
Administrative Decisions may take the following forms.
Determinations
Decisions resolving a particular factual, legal, technical, or administrative question.
Determinations may be used to decide:
- whether a person or organisation meets prescribed requirements;
- whether an application or submission is complete;
- whether a General Regulation applies in a particular case;
- whether a recognised status exists;
- whether evidence or conditions are sufficient;
- whether an exemption should be granted; or
- another question requiring a formal administrative finding.
Designations
Decisions assigning an official status to a named person, organisation, place, object, programme, or entity.
Designations may include:
- terrorist-organisation designations;
- sanctions and restrictive-measures designations;
- recognition of approved organisations;
- designation of official authorities or providers;
- designation of protected records, objects, or symbols;
- designation of an official programme, system, or service; and
- other legal or administrative classifications.
A Designation requiring the approval of the Sovereign shall record that approval in the published instrument.
Administrative Orders
Decisions requiring, permitting, suspending, or prohibiting a particular administrative action.
Administrative Orders may include:
- compliance orders;
- directions to correct or replace an official record;
- suspension of an application or administrative process;
- return or surrender of an official document;
- suspension or withdrawal of an authorisation;
- preservation of records or information; and
- directions requiring an organ to carry out a specified administrative act.
Administrative Orders are separate from orders issued by a court.
Approvals and Authorisations
Decisions granting permission or authority for a particular act, arrangement, programme, or function.
They may include:
- approval of an institutional arrangement;
- authorisation to exercise a delegated function;
- approval of a State programme or official system;
- permission to use an official designation or device;
- approval of an application requiring formal notice; and
- authorisation of an exception requiring higher approval.
Exemptions, Waivers, and Dispensations
Decisions allowing relief from an administrative requirement in a particular case.
They may include:
- exemption from a document or formatting requirement;
- waiver of a procedural deadline;
- approval of an alternative means of compliance;
- accommodation where strict compliance would be impracticable; and
- temporary relief from an administrative standard.
A dispensation granted personally by the Sovereign shall be published as a Sovereign Decision.
Suspensions, Revocations, and Withdrawals
Decisions altering or ending an existing administrative status, permission, recognition, or benefit.
They may include:
- suspension of an authorisation;
- revocation of an approval or recognition;
- withdrawal of an official status;
- cancellation of a Designation;
- removal from a State programme; and
- restoration following an earlier suspension or withdrawal.
